1. Acceptance of Terms

By accessing and using this transcription service, you accept and agree to be bound by the terms and provision of this agreement.

2. Use of Service

This service provides audio and video transcription capabilities. You agree to:

• Use the service only for lawful purposes
• Not upload content that infringes on third-party rights
• Not upload malicious files or attempt to compromise the system
• Be solely responsible for the content you upload
• Maintain the confidentiality of your account credentials
• Accept full responsibility for all activity under your account
• Not share your account credentials with others

3. User Responsibilities & Account Security

You are solely responsible for:

• Maintaining the security and confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account
• Ensuring your uploaded content does not contain sensitive or confidential information you do not wish to be processed
• Understanding that transcripts may be processed through third-party AI services

We are NOT liable for:

• Any loss or damage arising from your failure to maintain account security
• Unauthorized access to your account due to disclosed credentials
• Consequences of uploading sensitive, confidential, or inappropriate content
• Data breaches resulting from weak passwords or shared credentials

4. Credits and Payment

Transcription services require credits. New accounts receive zero (0) credits. To obtain credits, please contact sales. Credits are:

• Non-refundable once purchased
• Valid for use only within your account
• Consumed upon successful upload of media files

5. Data Processing & Retention

Original Media Files:

• Processed using AI transcription services
• Automatically deleted immediately after transcription completes (success or failure)
• Not retained beyond the time required for processing
• Typically deleted within minutes of upload
• May be sent to third-party AI services (OpenAI) for processing

Derived Data (Transcripts):

• Transcript text and metadata are retained until you delete them
• You have full control to delete transcripts and projects at any time
• Permanently deleted when you delete your account

Data Minimization: We strive to retain only derived data (transcripts) necessary for service functionality. Raw media files are not stored beyond processing requirements.

6. Intellectual Property

You retain all rights to your uploaded content. We claim no ownership over content you provide. Transcripts generated from your content belong to you.

7. Service Availability

Our servers are located in the United Kingdom.

We strive to provide continuous service but do not guarantee:

• Uninterrupted access to the service
• Error-free operation
• 100% transcription accuracy
• Availability of third-party AI services

8. Limitation of Liability

IMPORTANT: The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

To the maximum extent permitted by law, we are NOT liable for:

• Errors, inaccuracies, or omissions in transcriptions
• Loss of data due to technical issues, system failures, or third-party service disruptions
• Any damages (direct, indirect, incidental, consequential, or punitive) resulting from use of the service
• Unauthorized access to your account due to compromised credentials
• Loss or exposure of sensitive information you chose to upload
• Actions taken based on transcription results
• Third-party processing of your data (including OpenAI services)
• Service interruptions, delays, or unavailability
• Data loss resulting from user error, account deletion, or system issues

Maximum Liability: In no event shall our total liability exceed the amount you paid for credits in the 12 months preceding the claim.

Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any rights of another party.

9. Account Termination

We reserve the right to terminate accounts that:

• Violate these terms
• Engage in abusive behavior
• Upload prohibited content
• Attempt to compromise system security

Upon termination, all account data including transcripts will be permanently deleted in accordance with our data retention policy.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of new terms. Material changes will be notified via email or service notification.

11. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK
• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS
• WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS
• WE MAKE NO WARRANTY REGARDING QUALITY, ACCURACY, OR RELIABILITY
• ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE SERVICE IS AT YOUR OWN DISCRETION AND RISK
